1. Acceptance of Terms

By accessing or using the Dwello Africa platform — including our website, listings, messaging, and related services — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform. Dwello Africa Ltd reserves the right to update these terms at any time. Continued use after changes constitutes acceptance.

2. Who May Use Dwello Africa

• AgeYou must be at least 18 years old to create an account or list a property.
• EligibilityYou must be a human individual or a duly registered legal entity. Automated access is not permitted without written approval.
• Account accuracyYou agree to provide accurate and complete information when creating an account and to keep it up to date.
• Account securityYou are responsible for all activity on your account. Keep your password secure and notify us immediately if you suspect unauthorised access.

3. Listing Rules

Sellers, landlords, and agents who post listings on Dwello Africa agree to the following:

• OwnershipYou must have the legal right to list the property. You must not list a property you do not own or have authority to rent or sell.
• AccuracyAll listing information — including location, price, photos, and features — must be truthful and not misleading.
• DocumentsYou must submit valid ownership documents (title deed, land certificate, or lease) and identity verification before your listing goes live.
• Prohibited listingsYou may not list properties that are under embargo, involved in active legal dispute (without disclosure), or otherwise ineligible for sale or rent.
• UpdatesYou must update your listing promptly if the property is sold, rented, or otherwise no longer available.

4. Prohibited Conduct

You agree not to:

• FraudPost false, misleading, or fraudulent listings or profile information.
• ImpersonationPretend to be another person, company, or Dwello Africa staff.
• HarassmentSend abusive, threatening, or discriminatory messages to other users.
• ScrapingUse bots, scrapers, or automated tools to access or collect data from the platform without written permission.
• Off-platform paymentsRequest or accept payments outside the agreed transaction process in a way designed to circumvent platform safeguards.
• SpamSend unsolicited commercial communications to other users.

5. KYC and Verification

Sellers, landlords, and agents must complete identity verification (KYC) before listing. Submitting false or forged documents is a criminal offence and will result in permanent account suspension and referral to relevant authorities. Dwello Africa reserves the right to reject any submission at its discretion.

6. Transactions and Payments

Dwello Africa is a listing and discovery platform. We do not handle property payments or escrow services directly. Any transaction between a buyer and seller occurs independently. Dwello Africa is not a party to those transactions and accepts no liability for payment disputes, failed transactions, or losses arising from them. Always conduct due diligence before transferring money or signing any agreement.

7. Intellectual Property

All content on the Dwello Africa platform — including the logo, design, code, and editorial content — is owned by Dwello Africa Ltd and protected by copyright. You retain ownership of the content you upload (photos, listing descriptions) but grant Dwello Africa a non-exclusive, royalty-free licence to display and promote that content on the platform.

8. Disclaimers

• No warrantyThe platform is provided "as is". We do not guarantee uninterrupted access, error-free operation, or the accuracy of third-party information.
• No endorsementDisplaying a listing on Dwello Africa does not constitute our endorsement of the property, its price, or the seller.
• Verified badgeThe Dwello Verified badge confirms that submitted documents passed our review at the time of review. It is not a guarantee of title or investment value.

9. Limitation of Liability

To the fullest extent permitted by law, Dwello Africa Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — the platform, including losses from fraudulent listings, failed transactions, or data breaches beyond our reasonable control. Our total liability to you for any claim arising under these terms shall not exceed the fees you paid to us in the 12 months preceding the claim.

10. Termination

We may suspend or permanently close accounts that violate these terms, at our sole discretion and without prior notice where urgent action is required. You may delete your account at any time by contacting dwelloafricasupport@gmail.com. Certain terms — including intellectual property rights, disclaimers, and limitation of liability — survive termination.

11. Governing Law

These Terms of Service are governed by the laws of Ghana. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Accra, Ghana, unless otherwise required by the laws of your country of residence.
